After Marilyn Cappaert died, her accountant, Todd Boolos, asked Harris Barnes to provide legal services for the estate. BancorpSouth was the executor of the estate, and for eleven months Barnes provided the bank with monthly statements. He also filed five petitions and other legal documents with the court on behalf of BancorpSouth that were signed by the bank's trustee. BancorpSouth continued to allow Barnes to provide legal representation and made no objection to his representation until he was terminated.
