Ethical and Legal Issues in Selling
Sales people have to work under several legal and ethical obligations and this affects their profession to a large scale. If the sales people will not work with high personal and ethical standards, then this will affect their credibility alongwith the goodwill of the firm. It could be said that there are more legal and ethical issues in other jobs as compared to selling because in professions like accountancy, finance, retail store management etc. the employees and professionals have to be more alert and attentive towards not violating any of the legal and ethical standards while delivering their roles and responsibilities towards the actions they undertake. The employees of these profession have to oblige by legal statutes and ethical obligations meant for delivering their services to the customers. The issues that are likely to be present in every profession are being honest for the company, making proper use of the company's assets, resolving conflicts of interests, creating good relationship with customers, suppliers and government, saying no to fraud and misrepresentation etc. While, the issues that are likely to be specific to the sales job are not indulging in fraud and misrepresentation, making proper use of company's assets, giving best services to the customers, obliging with the company's policies and procedures etc.
Internet has provided the business organizations a great opportunity to expand their business and sales volume through facilitating them with cost effective marketing opportunities, high range of customer coverage, increase in brand recognition and improved relationship with the customers. From the current business activities it is identified that the organizations which are following corporate social responsibility and ethical conduct, are maintaining its ethics over internet business operations also. They accept the importance and sensitivity of the information over the internet and install various security programmers to safeguard themselves from the malpractices. But there are many fraudulent activities which are happening over the internet. In some cases the organization performs unethical activities by providing wrong information on their websites to attract customers. Some may call on behalf of the business organization and can deceive customers. Hence, it can be concluded that ethical and unethical activities share an equal dominance, while the business organizations that have good market reputation adopts stringent measures to curb any unethical practices over internet.

Caveat emptor stands for the principle that gives the buyer the sole responsibility for checking the quality and suitability of the goods that he is buying from the seller before making a final purchase. This principle has been working since centuries but in today's times this principle no longer works in the selling relationship because today the concept of selling partnership is taken as a basis for selling the goods to the customers. It stands for the process wherein the seller sells the products to the buyer with the intention and purpose of not only selling the product or a service but also to build a selling partnership with the buyer making the buyer to continue and remain loyal with the product and service that is sold by the seller. This way it could be said that the ethics are considered quite highly in the selling process wherein the seller will not try to dupe or undertake fraudulent misrepresentation with the customers just to gain profits and making the goods to get sold suggesting that the evolution of selling has influenced ethics in professional selling.
